Terms of Use

Version 2.0. The Slovenian version is the primary legal version; the English version is provided for convenience. In case of conflict, the Slovenian version prevails.

1. Who we are

The Funkie service is provided by:

Hereinafter: "Funkie", "we", "the provider". A natural or legal person using the service is the "user"; an activity provider is the "provider".

2. About the service

Funkie is a platform for discovering fun activities in Slovenia. The service includes:

  • the Funkie mobile app (iOS, later Android) for end users;
  • the funkie.si website - informational and marketing presentation;
  • the business.funkie.si platform - registration and listing management for activity providers.

Funkie is not a booking platform. Funkie does not broker, confirm, or process bookings or payments for individual activities. Funkie acts solely as a catalogue directing users to the activity provider (phone, email, provider's website, directions).

3. Contract and acceptance

By creating an account in the app or signing up on the business platform you enter into a contract with the provider on these terms. By using the service you confirm you have read, understood, and accept these terms. If you do not accept these terms, do not use the service.

4. Eligibility

To use the service, the user must:

  • be at least 16 years old (for self-registration without parental consent);
  • have legal capacity to enter into a contract under the Slovenian Code of Obligations.

Providers must additionally:

  • be a registered legal entity, sole trader, or other person authorised to operate entertainment activities in Slovenia;
  • have authority to represent the business;
  • operate in or run activities within Slovenia.

5. User accounts

5.1 Account types. Funkie supports (a) anonymous guest sessions, (b) registered accounts (email + sign-in code or password), and (c) business accounts for providers.

5.2 Account security. The user is responsible for keeping credentials confidential and for all activity performed via their account.

5.3 Accuracy of data. The user undertakes to provide accurate, complete, and up-to-date information at registration and to keep it current.

5.4 Account deletion. The user may delete their account at any time via the app (Profile → Delete account) or by email request. Account deletion removes all associated personal data except data we must retain by law (accounting records).

6. Acceptable use

Users undertake NOT to:

  • attempt unauthorised access to the system, database, other accounts, or internal infrastructure;
  • disrupt the service, perform DoS attacks, scanning, scraping, or similar acts;
  • use the service for unlawful purposes or in violation of good business practice;
  • use bots, automated scripts, or other means for mass access, without explicit written authorisation;
  • submit false, misleading, or inappropriate content;
  • infringe intellectual property rights of the provider or third parties;
  • use the service to send unsolicited commercial communications (spam) or to harvest third-party data without a lawful basis.

Breach gives the provider the right to immediately suspend or terminate the account without refund of any subscription paid.

7. Activity providers

7.1 Listing content. The provider is fully responsible for the accuracy and completeness of all information in its listing (activity name, address, prices, opening hours, description, photos, contact details).

7.2 Right of review. Funkie reserves the right to review listings before publication and reject those that violate the law or platform rules. Funkie has no obligation to actively monitor published content but may remove any listing that violates the law or rules at any time.

7.3 Permitted activities. Funkie is exclusively focused on fun activities: go-karts, escape rooms, zip lines, climbing, paintball, laser tag, bowling, trampoline parks, adventure parks, rafting, kayaking, SUP, paragliding, canyoning, horseback riding, mini golf, disc golf, archery, axe throwing, ice skating, summer sledding, mountain biking, and similar experiences.

7.4 Not permitted. Funkie does not accept: restaurants, bars, cafes; hotels, apartments, accommodation; spa, wellness, massage; beauty and cosmetic services; retail and other non-activity services.

7.5 Listing limit. Standard plans (Free, Founders, Pro) allow up to four (4) activity listings per provider. Providers with 5+ activities or multiple locations must agree a custom plan.

7.6 Content rights. The provider retains ownership of its content. By submitting content, the provider grants the provider a free, non-exclusive, transferable, worldwide licence to display the content in the Funkie app, on the website, and in marketing materials solely for promoting the platform and the provider. The licence terminates 12 months after provider deregistration.

7.7 Provider liability. The provider is fully responsible for the conduct of its activity, safety, regulatory compliance (occupational safety, insurance, permits, age limits), and the handling of its customers. Funkie is not a party to the relationship between user and provider and is not liable for the quality, safety, or conduct of the activity.

8. Pricing and payment (for providers)

8.1 Plans. Funkie offers three tiers: Free, an annual paid plan (Founders at €250/year or Pro at €500/year depending on the signup window), and a custom plan for providers with more than 4 activities. The current pricing is published on business.funkie.si.

8.2 Founder pricing. Between 18 May 2026 and 31 August 2026, the paid tier is offered at €250/year (excl. VAT) as a founder rate. The rate at which a provider signs up during this window is locked for the lifetime of its continuous subscription. From 1 September 2026, the standard rate of €500/year (excl. VAT) applies to new subscriptions.

8.3 No commissions. Funkie does not charge commission on bookings or on customer visits. The provider retains 100% of its revenue.

8.4 Payments. Payments are made annually in advance. The provider issues invoices in compliance with Slovenian VAT law (ZDDV-1).

8.5 Subscription term. The subscription is concluded for one year and auto-renews unless either party notifies the other in writing at least 30 days before the end of the current term. The provider may cancel at any time without fees; cancellation takes effect at the end of the current paid period. Pro-rata refunds are not available.

8.6 Price changes. The provider reserves the right to change the standard price with 30 days' notice. Locked founder pricing is not affected.

9. Intellectual property

All intellectual property rights in the Funkie name, logo, design, software (app, websites, API), databases, and marketing materials are the exclusive property of the provider. Use is permitted only within these terms. Any other use requires written consent.

10. Service availability

The provider endeavours to provide uninterrupted service but does not guarantee 100% availability. The service may be temporarily unavailable due to maintenance, updates, security measures, or external events. The provider is not liable for damages arising from occasional unavailability.

11. Limitation of liability

The service is provided "as is". To the extent permitted by applicable law, the provider is not liable for:

  • quality, safety, or conduct of third-party (provider) activities to which it directs users;
  • accuracy of prices, opening hours, or other data submitted by providers;
  • indirect damages, lost profits, lost business opportunity, or data loss;
  • errors or outages of third-party providers (Hetzner, Apple, Neoserv, mobile carriers);
  • force majeure - natural disasters, war, cyberattacks not reasonably foreseeable.

The aggregate liability of the provider to a single provider for any single contract year shall not exceed the annual subscription paid for that year.

Nothing in these terms limits liability for intentional misconduct, gross negligence, personal injury, death, or other liability that cannot be excluded by applicable law.

12. Consumer rights

Users acting as consumers within the meaning of the Slovenian Consumer Protection Act (ZVPot-1) enjoy all rights mandated by Slovenian consumer law and EU law. Nothing in these terms shall be construed as waiving such rights.

Users have the right to alternative dispute resolution under the Slovenian Out-of-Court Settlement of Consumer Disputes Act and via the EU Online Dispute Resolution platform (ODR): ec.europa.eu/consumers/odr.

13. Privacy

Personal data processing is governed by the Privacy Policy. By using the service you acknowledge having read it.

14. Suspension and termination

The provider may suspend or terminate a user's account for breach of these terms, breach of law, or harm to the operation or reputation of the service. In case of serious breach or breach endangering service security, termination may occur without prior notice. Otherwise the provider will notify the user and provide an opportunity to cure the breach.

15. Changes to the terms

The provider may amend these terms occasionally. Material changes will be published on funkie.si and business.funkie.si at least 30 days before they take effect. If you disagree with the changes, you may cancel your account during this period. Continued use after the changes take effect constitutes acceptance.

16. Governing law and jurisdiction

These terms are governed by Slovenian law, without regard to conflict-of-laws rules. Disputes shall be resolved amicably where possible. Failing amicable resolution, the competent court in Koper, Slovenia, has subject-matter jurisdiction.

For consumers, jurisdiction is determined by the Slovenian Civil Procedure Act and the EU Brussels Regulation.

17. Severability

If any provision of these terms becomes null, invalid, or unenforceable, this does not affect the remainder. The parties will replace any invalid provision with one closest in substance and purpose to the original.
